1. INTRODUCTION

Welcome to MyNeighborTheMechanic.com (“Company,” “Platform,” “we,” “our,” or “us”).

These Terms of Service (“Terms”) govern your access to and use of the MyNeighborTheMechanic.com website, mobile application, and any related services (collectively, the “Platform”).

By creating an account, browsing the Platform, requesting services, accepting work, or otherwise using the Platform, you agree to be legally bound by these Terms.

If you do not agree with these Terms, do not use the Platform.

2. OUR SERVICE

MyNeighborTheMechanic.com provides an online marketplace that connects vehicle owners (“Customers”) with independent automotive repair professionals (“Mechanics”).

The Platform provides technology that allows Customers and Mechanics to locate one another, communicate, schedule appointments, and process payments.

MyNeighborTheMechanic.com is NOT an automotive repair shop.

We do not:

  • perform repairs
  • supervise repairs
  • inspect repairs
  • certify repairs
  • guarantee repairs
  • employ mechanics

All repair services are provided solely by independent Mechanics.

3. DEFINITIONS

Throughout these Terms:

Customer means a person requesting automotive repair services.

Mechanic means an independent individual or business offering automotive repair services through the Platform.

Booking means a scheduled appointment created through the Platform.

Vehicle means any automobile, truck, SUV, van, motorcycle, recreational vehicle, trailer, or other motor vehicle serviced through the Platform.

Content includes photographs, videos, reviews, estimates, invoices, messages, listings, logos, and any information submitted by users.

4. ELIGIBILITY

To use the Platform you must:

  • be at least 18 years old;
  • have legal capacity to enter contracts;
  • provide accurate information;
  • maintain a valid email address;
  • maintain a valid payment method if booking services.

Mechanics may be required to provide:

  • driver’s license
  • government identification
  • business license (where applicable)
  • proof of insurance
  • certifications
  • tax information

The Company may deny or terminate any account at its sole discretion.

5. ACCOUNT REGISTRATION

Users agree that all registration information shall remain accurate and current.

You are responsible for:

  • maintaining password security;
  • all activity under your account;
  • notifying us immediately of unauthorized access.

You may not:

  • create multiple fraudulent accounts;
  • impersonate another person;
  • share your account

6. INDEPENDENT CONTRACTOR RELATIONSHIP

Mechanics using MyNeighborTheMechanic.com are independent contractors.

Nothing contained within these Terms creates:

  • employment
  • agency
  • franchise
  • partnership
  • joint venture

Mechanics determine:

  • their own hours;
  • pricing (subject to Platform rules);
  • service area;
  • acceptance or rejection of jobs;
  • methods of repair.

The Company exercises no control over how repairs are performed.

7. BOOKINGS

Customers may request services through the Platform.

A Booking is not final until accepted by the Mechanic.

Mechanics may decline requests for any lawful reason.

The Company is not responsible if:

  • a Mechanic cancels;
  • a Customer cancels;
  • weather prevents repairs;
  • parts become unavailable;
  • repairs take longer than expected.

8. PAYMENTS

Payments are processed through approved third-party payment providers.

Customers authorize the Platform to collect:

  • repair charges;
  • service fees;
  • taxes;
  • cancellation fees (when applicable).

Mechanics authorize the Platform to deduct:

  • platform commissions;
  • payment processing fees;
  • dispute adjustments;
  • refunds where appropriate.

The Platform is not responsible for delays caused by payment processors or financial institutions.

9. ESTIMATES

Repair estimates provided through the Platform are estimates only.

Actual repair costs may vary due to:

  • hidden damage;
  • additional labor;
  • additional parts;
  • diagnostic findings;
  • manufacturer requirements.

Mechanics agree not to perform work exceeding the approved estimate without Customer authorization except where necessary to prevent immediate safety hazards.

10. CUSTOMER RESPONSIBILITIES

Customers agree to:

  • accurately describe vehicle problems;
  • provide safe access to the vehicle;
  • ensure the vehicle is legally owned or authorized for repair;
  • remove valuables before service;
  • pay all agreed charges;
  • inspect completed work before accepting the vehicle.

Customers acknowledge that delaying necessary repairs may result in additional damage.

11. MECHANIC RESPONSIBILITIES

By offering services through MyNeighborTheMechanic.com, each Mechanic represents and warrants that they:

  • Are legally authorized to perform automotive repair services in the jurisdictions where they operate.
  • Will perform all services in a professional and workmanlike manner.
  • Will comply with all applicable federal, state, and local laws.
  • Will accurately represent their experience, certifications, licenses, and qualifications.
  • Will not knowingly recommend unnecessary repairs.
  • Will provide honest estimates based upon reasonable inspection.
  • Will notify Customers of any additional work before performing repairs that exceed the approved estimate.
  • Will maintain a safe work environment.
  • Will not perform repairs while impaired by alcohol, illegal drugs, or any condition that affects safe workmanship.
  • Will maintain all tools and equipment in safe operating condition.

Mechanics are solely responsible for:

  • Their workmanship
  • Their business licenses
  • Their taxes
  • Their insurance
  • Their employees or assistants
  • Compliance with environmental regulations governing disposal of fluids, batteries, tires, and hazardous materials

Mechanics acknowledge they are independent businesses and are solely responsible for any warranties they provide unless expressly stated otherwise.

12. BACKGROUND CHECKS & VERIFICATION

To promote trust within the community, MyNeighborTheMechanic.com may require Mechanics to complete identity verification.

The Company may request:

  • Government-issued identification
  • Driver’s license verification
  • Proof of business registration
  • Proof of insurance
  • ASE certification documentation
  • Other documentation reasonably necessary to verify identity or qualifications

The Company may also conduct background screenings where permitted by law.

Completion of any verification process does not constitute a guarantee of honesty, competence, skill, or future performance.

Customers acknowledge that they remain responsible for selecting the Mechanic they choose to hire.

13. ASE CERTIFICATION

Mechanics may indicate that they hold certifications issued by the National Institute for Automotive Service Excellence (ASE) or other recognized organizations.

Mechanics are solely responsible for ensuring that any certification claims are truthful and current.

False claims regarding certifications are grounds for immediate suspension or permanent removal from the Platform.

The Company does not independently guarantee the validity or ongoing status of certifications unless specifically stated.

14. MOBILE REPAIR SAFETY

Customers acknowledge that many repairs occur:

  • At private residences
  • Apartment complexes
  • Business parking lots
  • Public parking areas
  • Roadside locations

Customers agree to provide a reasonably safe location for repairs.

Mechanics may refuse service if a location presents an unreasonable safety risk, including but not limited to:

  • Dangerous traffic conditions
  • Severe weather
  • Unsafe vehicle placement
  • Criminal activity
  • Aggressive animals
  • Inadequate lighting
  • Hazardous environmental conditions

If a Mechanic reasonably determines that a repair location is unsafe, the appointment may be canceled or relocated without liability to the Mechanic or the Company.

15. PARTS

Mechanics may install:

  • New parts
  • Remanufactured parts
  • Rebuilt parts
  • Used parts
  • Customer-supplied parts

The Mechanic shall disclose the type of parts being installed whenever reasonably possible.

MyNeighborTheMechanic.com does not manufacture, distribute, inspect, or warrant any automotive parts.

Any manufacturer’s warranty applies solely through the manufacturer or supplier.

16. WARRANTIES

Unless otherwise expressly agreed in writing between the Customer and the Mechanic:

  • The Company provides no warranty regarding repairs.
  • The Company provides no warranty regarding parts.
  • The Company provides no warranty regarding labor.
  • The Company provides no warranty regarding future vehicle performance.

Any workmanship warranty is solely between the Customer and the Mechanic.

Mechanics are encouraged—but not required—to publish their warranty policies on their profile.

17. CUSTOMER REVIEWS

Customers may leave reviews following completion of a service.

Reviews must be:

  • Truthful
  • Based upon actual experience
  • Free from profanity
  • Free from threats
  • Free from discrimination
  • Free from false statements

The Company reserves the right to remove reviews that:

  • Contain false information
  • Reveal private information
  • Violate applicable laws
  • Constitute harassment
  • Promote competing businesses
  • Are submitted in exchange for compensation

Mechanics may not offer money, discounts, or gifts in exchange for positive reviews.

MyNeighbor Guarantee™

This would be a badge displayed on qualifying mechanics who meet higher standards, such as:

  • Verified identity
  • ASE Certified
  • Background checked
  • 4.8+ average rating
  • Minimum 50 completed jobs
  • Carries liability insurance
  • Responds within 30 minutes
  • No unresolved customer complaints

18. INSURANCE

Customer Insurance

Customers are responsible for maintaining any automobile insurance required by applicable law.

The Company does not provide automobile insurance covering vehicles serviced through the Platform.

Customers acknowledge that any claims arising from repair work may be subject to the terms and limitations of their own insurance policies.

Mechanic Insurance

Mechanics are strongly encouraged, and in some cases may be required, to maintain insurance appropriate for the services they provide, including:

  • General Liability Insurance
  • Garage Keepers Liability (where applicable)
  • Commercial Auto Insurance
  • Workers’ Compensation Insurance (if required by law)
  • Professional Liability Insurance (where available)

Mechanics are solely responsible for maintaining any insurance required by federal, state, or local law.

Failure to maintain required insurance may result in suspension or removal from the Platform.

The Company does not verify or guarantee that any Mechanic maintains insurance unless expressly stated.

19. PROPERTY DAMAGE

Customers understand that automotive repair carries inherent risks.

The Company shall not be responsible for:

  • Damage caused by a Mechanic
  • Incorrect diagnosis
  • Failed repairs
  • Improper installation
  • Mechanical failure
  • Vehicle breakdown
  • Fire
  • Theft
  • Loss of use
  • Towing expenses
  • Rental vehicle costs
  • Diminished vehicle value

Claims regarding repair work must be resolved directly between the Customer and the Mechanic.

20. EMERGENCY SERVICES

Mechanics may offer emergency roadside assistance through the Platform.

Customers acknowledge that roadside repairs involve additional risks.

Mechanics reserve the right to refuse service if they believe conditions are unsafe.

The Company does not guarantee:

  • Response times
  • Repair success
  • Vehicle operability
  • Availability of Mechanics

21. LIMITATION OF LIABILITY

To the fullest extent permitted by law, MyNeighborTheMechanic.com, its owners, officers, directors, employees, affiliates, contractors, licensors, successors, and assigns shall not be liable for any:

  • Personal injury
  • Death
  • Vehicle damage
  • Property damage
  • Loss of income
  • Lost profits
  • Loss of business
  • Loss of opportunity
  • Loss of goodwill
  • Towing costs
  • Rental vehicle expenses
  • Consequential damages
  • Incidental damages
  • Punitive damages
  • Indirect damages

Whether arising from:

  • Negligence
  • Contract
  • Tort
  • Warranty
  • Product liability
  • Strict liability
  • Statute
  • Any other legal theory

The Company’s total liability under any claim shall not exceed the total Platform service fees paid by the Customer during the twelve (12) months immediately preceding the event giving rise to the claim.

22. DISCLAIMER OF WARRANTIES

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.”

THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • TITLE
  • NON-INFRINGEMENT
  • ACCURACY
  • RELIABILITY
  • AVAILABILITY

The Company does not warrant:

  • That Mechanics are qualified
  • That repairs will solve a vehicle problem
  • That repairs comply with manufacturer specifications
  • That parts are defect-free
  • That appointments will occur as scheduled
  • That the Platform will be uninterrupted or error-free

Customers use the Platform entirely at their own risk.

23. INDEMNIFICATION

Users agree to defend, indemnify, and hold harmless MyNeighborTheMechanic.com and its owners, officers, directors, employees, affiliates, contractors, and agents from any claims, liabilities, damages, losses, judgments, settlements, costs, expenses, or attorneys’ fees arising from:

  • Their use of the Platform
  • Their violation of these Terms
  • Their violation of applicable law
  • Their negligence or misconduct
  • Vehicle repairs
  • Vehicle accidents
  • Property damage
  • Personal injury
  • Intellectual property infringement
  • Misrepresentation
  • Fraud

This obligation survives termination of the user’s account.

24. USER CONTENT

Users retain ownership of content they submit to the Platform, including:

  • Photos
  • Videos
  • Reviews
  • Estimates
  • Vehicle descriptions
  • Profile information

By posting content, users grant the Company a worldwide, perpetual, royalty-free, transferable, sublicensable license to use, reproduce, modify, display, distribute, and promote such content in connection with operating and marketing the Platform.

Users represent that they own or have permission to use all submitted content.

25. INTELLECTUAL PROPERTY

The following are the exclusive property of MyNeighborTheMechanic.com:

  • Name
  • Logo
  • Trademarks
  • Service marks
  • Website design
  • Software
  • Graphics
  • Mobile application
  • Databases
  • Source code
  • Marketing materials

No user acquires ownership rights by using the Platform.

Users may not:

  • Copy
  • Reverse engineer
  • Modify
  • Sell
  • License
  • Redistribute
  • Create derivative works from Company property without prior written permission.

26. PROHIBITED CONDUCT

Users may not:

  • Commit fraud
  • Misrepresent qualifications
  • Perform illegal repairs
  • Perform repairs while impaired
  • Upload malicious software
  • Interfere with Platform operations
  • Harass other users
  • Post false reviews
  • Circumvent Platform payments
  • Solicit users to conduct transactions outside the Platform
  • Attempt to hack or gain unauthorized access
  • Violate applicable laws
  • Use another person’s identity
  • Create fake accounts
  • Spam users
  • Upload offensive or unlawful content

The Company may suspend or permanently terminate any account for violations of these Terms.

27. PRIVACY

Your use of MyNeighborTheMechanic.com is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

The Company may collect information including:

  • Name
  • Address
  • Email address
  • Telephone number
  • Vehicle information
  • Payment information
  • GPS location (when authorized)
  • Device information
  • Communications through the Platform

The Company uses this information to:

  • Operate the Platform
  • Process payments
  • Schedule appointments
  • Improve services
  • Prevent fraud
  • Comply with legal obligations
  • Communicate with users

The Company will not sell users’ personal information except as permitted by applicable law or described in the Privacy Policy.

28. ELECTRONIC COMMUNICATIONS

By creating an account, users consent to receive electronic communications from the Company, including:

  • Appointment confirmations
  • Payment receipts
  • Account notifications
  • Security alerts
  • Policy updates
  • Marketing communications (where permitted by law)

Users may opt out of promotional communications but may continue to receive essential account and service-related notices.

29. TERMINATION OF ACCOUNTS

The Company may suspend or terminate any account at any time, with or without notice, for reasons including but not limited to:

  • Violation of these Terms
  • Fraudulent activity
  • Illegal conduct
  • Safety concerns
  • Repeated customer complaints
  • False advertising
  • Chargeback abuse
  • Misrepresentation
  • Non-payment of fees

Termination does not relieve a user of obligations incurred before termination.

30. DISPUTES BETWEEN USERS

The Company is not a party to agreements between Customers and Mechanics.

While the Company may, at its sole discretion, assist in resolving disputes, it is under no obligation to investigate, mediate, or resolve disagreements.

Customers and Mechanics remain solely responsible for resolving disputes concerning:

  • Repair quality
  • Payment
  • Estimates
  • Parts
  • Warranties
  • Scheduling
  • Property damage

31. DISPUTE RESOLUTION

Before initiating legal proceedings, the parties agree to make a good-faith effort to resolve disputes informally by providing written notice describing the issue and the requested resolution.

If the dispute cannot be resolved within thirty (30) days, either party may pursue arbitration as provided below.

32. BINDING ARBITRATION

Except where prohibited by law, any dispute arising out of or relating to these Terms or the use of the Platform shall be resolved exclusively through binding arbitration.

The arbitration shall:

  • Be conducted by a mutually agreed arbitration provider.
  • Be conducted by a single arbitrator.
  • Take place in Los Angeles County, California, unless the parties agree otherwise.
  • Be conducted in English.

Each party shall bear its own attorneys’ fees unless otherwise awarded by the arbitrator or required by law.

33. CLASS ACTION WAIVER

To the fullest extent permitted by law:

Users agree that claims shall be brought only in an individual capacity.

Users waive any right to:

  • Participate in class actions.
  • Participate in representative actions.
  • Participate in consolidated proceedings.

No arbitrator may combine multiple claims into a single proceeding without the written consent of all parties.

34. GOVERNING LAW

These Terms shall be governed by and interpreted under the laws of the State of California, without regard to conflict-of-law principles.

If any portion of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

35. FORCE MAJEURE

The Company shall not be liable for delays or failures caused by events beyond its reasonable control, including but not limited to:

  • Natural disasters
  • Wildfires
  • Floods
  • Earthquakes
  • Pandemics
  • Labor disputes
  • Government actions
  • Power outages
  • Internet failures
  • Cyberattacks
  • Transportation disruptions

36. MODIFICATIONS TO THESE TERMS

The Company may revise these Terms at any time.

Updated Terms become effective upon posting to the Platform unless otherwise required by law.

Continued use of the Platform after updated Terms are posted constitutes acceptance of the revised Terms.

37. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy and any additional policies referenced herein, constitute the entire agreement between the Company and the user regarding use of the Platform.

They supersede all prior oral or written agreements concerning the Platform.
